Terms and Conditions of Entry

To be an eligible entrant for the Kissable Curves "FREE Halloween Costume Giveaway", you must review and agree to abide by and be bound by Kissable Curves "FREE Halloween Costume Giveaway" Terms and Conditions of Entry (the "Terms and Conditions"). By submitting a completed offer on the kissablecurves.com website, signing up to receive emails, you will automatically receive one entry into the Giveaway. Your participation in the Giveaway is governed by and subject to these Terms and Conditions.

1. No Purchase Necessary. NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN THE GIVEAWAY. THE GIVEAWAY IS VOID WHERE PROHIBITED BY LAW AND IS SUBJECT TO APPLICABLE FEDERAL, STATE, AND LOCAL LAW. The Giveaway is sponsored by JH Enterprises, Inc., with a mailing address of P.O. Box 116, Bellevue, NE 68005 (the "Sponsor"). The Giveaway begins on 9/1/2010 and ends on 9/30/2010 (the "Entry Period").

2. Eligibility. Eligible entrants must be 18 years of age or older and must agree to these Terms and Conditions. Entries will not be intentionally accepted from individuals under the age of 18, and any such entries are void. The Gieaway is offered only in the United States of America. Persons who are not U.S. residents are not eligible to participate in the Giveaway, and any entries by such persons are void. Persons who are employees, officers, directors, agents or representatives of Sponsor, participating publishers, their respective parent corporations, affiliates, subsidiaries, advertising and promotion agencies, suppliers, distributors, and members of the immediate family (defined as mother, father, sister, brother, daughter, son or spouse, regardless of where they live), and those living in the same household of each (whether related or not), are not eligible. Limit of one entry per offer per person, per household, per email address.

3. How to Enter. Complete an entry form on the kissablecurves.com website, including providing your name, email address, phone number, physical and/or mailing address, date of birth, signing up to receive emails and acknowledging that you have read and agree to these Terms and Conditions.. To be valid, entries must be submitted through a bona fide entry form completion. You may also send a 3x5 card addressed to Kissable Curves "FREE Halloween Costume Giveaway", P.O. Box 5025, San Pedro, CA 90733; the 3x5 card must state Kissable Curves "FREE Halloween Costume Giveaway" on it along with your email address, and it must bear a post-mark issued by the United States Post Office. Any other attempted entries are void. Any entry form containing incomplete, incorrect, or unintelligible information is void. Sponsor is not responsible for late, lost, damaged, or misdirected entries. BY ENTERING THIS GIVEAWAY, ENTRANTS MUST AGREE (1) TO BE BOUND BY THESE GIVEAWAY TERMS AND CONDITIONS, (2) THAT THEY HAVE READ AND UNDERSTAND THE TERMS OF THE KISSABLE CURVES PRIVACY POLICY, POSTED AT HTTP://WWW.KISSABLECURVES.COM/PRIVACY.PHP, (3) TO HOLD SPONSOR HARMLESS FROM AND AGAINST ANY CLAIMS OR LIABILITIES ARISING DIRECTLY OR INDIRECTLY FROM THIS GIVEAWAY. Any data submitted to Sponsor pursuant to entering this Giveaway becomes the property of Sponsor and may be used for any legal purpose including conducting email marketing.

4. Drawing. All eligible entries received during the Entry Period will be entered into a random drawing to be held during the first thirty (10) days after the end of the Entry Period or as soon thereafter as practicable. The potential prize winner may be notified by email at the email address provided, or by other means, depending upon the contact information provided by the entrant. Odds of winning are determined by the total number of valid, timely, and eligible entries received during the Entry Period.

5. Prize. One (1) prize will be awarded. The Giveaway prize is one (1) Halloween Costume with Free Shipping, with an approximate retail value of $70 to $150 + shipping. All values are stated in U.S. dollars. The prize cannot be substituted, assigned or transferred by a winner prior to award. Sponsor reserves the right, at its sole discretion, to substitute a prize of equal or greater value should the featured prize become unavailable for any reason.

6. Prize Claim. The Giveaway winner will be notified by email or other means within ten (10) business days of the Sweepstakes drawing in which the winning entry was selected. The prize is non-transferable. If the prize is not claimed by the winner within seven (7) days after notification from Sponsor, the prize may be forfeited and the selection of another entrant from among all eligible entries received. Sponsor reserves the right to require the winner to prove identification, to prove eligibility, and to return a signed and notarized Affidavit of Eligibility, and Liability and Publicity Release Form (the "Eligibility Form") in order to claim the prize. The Eligibility Form certifies eligibility and compliance with these Terms and Conditions and serves to release and to hold harmless Sponsor, and its affiliates, parents, subsidiaries, publishers, advertisers, and agencies from an against any liability arising out of the Giveaway. Failure to timely return the Eligibility Form will result in forfeiture of the prize. A prize notification returned as undeliverable will result in forfeiture of the prize. The prize winner is responsible for all applicable taxes. The prize winner and prize will be reported to governmental tax authorities as required by law.

7. General Rules. Sponsor is not responsible or liable for lost, late, incomplete or misdirected entries; or for any computer, telephone, Internet, cable, network, electronic or other hardware of software malfunctions, failures, connections, availability or garbled transmissions, or Internet accessibility or availability, traffic congestion, or unauthorized human intervention. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process, the operation of the Giveaway or web site; who is entering the Giveaway for any reason other than a bona fide intent to enter and try to win; or to be acting in violation of these Terms and Conditions. Any use of robotic, automatic, macro, programmed or similar entry methods will void all entries by such methods. By submitting an entry for this Giveaway, you agree to abide by these rules and any decision Sponsor makes regarding these Giveaway, which are final and binding in all respects; generally, in the event of dispute about the identity of a prize winner, the winning entry will be deemed made by the Account Holder of the email address submitted at the time of entry. "Account Holder" means the natural person who is listed as the owner of an email address by an Internet service provider or other organization that is responsible for assigning email addresses. Whether an entrant is eligible is solely within the discretion of Sponsor. A potential winner may be required to provide Sponsor with proof that he or she is the account holder of the email address associated with the potential winning entry. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by web site users, tampering or unauthorized access, or by any of the equipment or programming associated with or utilized in the Giveaway and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction or unauthorized access to the web site. Sponsor is not responsible for injury or damage to entrants or to any other person's computer related to or resulting from participating in this Giveaway. IF, FOR ANY REASON, THE GIVEAWAY IS NOT CAPABLE OF RUNNING AS PLANNED (FOR EXAMPLE BUT NOT BY WAY OF LIMITATION, BY REASON OF THE TERMINATION OF A PUBLISHER'S RELATIONSHIP WITH SPONSOR, INFECTION BY COMPUTER VIRUS, WORMS, BUGS, TAMPERING, UNAUTHORIZED INTERVENTION, FRAUD, TECHNICAL FAILURES, OR ANY OTHER CAUSES WHICH COULD CORRUPT OR AFFECT THE ADMINISTRATION, SECURITY, FAIRNESS, INTEGRITY OR PROPER CONDUCT OF THIS SWEEPSTAKES), SPONSOR RESERVES THE RIGHT AT ITS SOLE DISCRETION TO CANCEL, TERMINATE, MODIFY OR SUSPEND THIS GIVEAWAY AT ANY TIME. All federal, state and local taxes are the sole responsibility of the winner. Sponsor reserves the right to disqualify entrants who fail to follow these Terms and Conditions, applicable laws and regulations or who make any misrepresentations relative to the Sweepstakes, their entries, and claiming of a prize. Entry constitutes permission to use winners' names, addresses, photographs, video footage and/or voice recordings for publicity purposes (including posting on-line) without additional compensation or permission except where prohibited by law. Sponsor and its affiliates, parents, subsidiaries, agencies and each of their respective officers, directors, employees, agents, successors and assigns are not responsible for any negligence, claims, liability, injury, property loss or other damages of or to participants and/or the winner arising from, or in connection with this Giveaway. This Giveaway is subject to applicable federal, state and local laws and regulations.

8. Conditions. Upon delivery of a prize to a winner, Sponsor will be deemed to have awarded the prize to the winner with winner assuming full ownership and responsibility for the prize. CAUTION: Any attempt made by an entrant to deliberately damage Sponsor's or a Sponsor publisher website or undermine the legitimate operation of the Giveaway is a violation of criminal and civil laws. Should such an attempt be made, or if the Sponsor suspects that there has been any electronic tampering or if technical difficulties compromise the integrity of the Giveaway, Sponsor reserves the right to seek damages from any such entrant as permitted by law and to void such participant's entries from the Giveaway. THIS GIVEAWAY IS SOLELY AND EXCLUSIVELY GOVERNED BY THE LAWS OF THE STATE OF NEBRASKA AS APPLICABLE TO CONTRACTS MADE AND PERFORMED WHOLLY THEREIN. ANY ACTION, PROCEEDING OR LITIGATION RELATING TO THIS GIVEAWAY MUST BE INSTITUTED AND PROSECUTED SOLELY AND EXCLUSIVELY WITHIN A STATE OR FEDERAL COURT LOCATED IN THE STATE OF NEBRASKA, SARPY COUNTY, BELLEVUE.
